Consent letter for cross-border transfer of personal information of residents in China

Basic background, purpose of data transfer, and types of data transferred

According to Article 39 of the Personal Information Protection Law of the People's Republic of China, as well as relevant provisions of laws and regulations such as the Measures for Security Assessment of Data Export and Regulations on Promoting and Standardizing Cross-Border Data Flow, in order to support and enable you to complete the talent acquisition and talent management process, the British Council China (“We”; “Us”), upon obtaining your consent, will transfer overseas your general personal information provided on the application form (full name, phone number, email, district, province, city, zip code, country, date of birth, gender, nationality, details of work history), twelve items in total of personal information, for access and processing by overseas recipients, to ensure the progress of the talent acquisition and talent management process.

Scope and handling of sensitive information involved in the transfer

You acknowledge and agree that the personal information involved in this transfer does not include sensitive information.

Names and information of overseas recipient and its third-party service provider

Your personal information will be transferred and shared with the British Council UK, who has contracted a service provider to provide talent acquisition and talent management services to the British Council.. Eightfold AI Inc. (Eightfold) is a third-party technology service provider, engaged by the overseas recipient, which utilizes data centres in Germany (primary facility) and Ireland (back-up facility), and is subject to applicable laws.”

Purpose of processing by overseas recipient

During the recruitment process we collect your personal information on the basis that you may be offered a contract of employment. We need your personal information to determine whether you can be appointed successful into a role, following a competitive recruitment and interview process.

In the above process, your personal information will be shared with the overseas recipient, resulting in the transfer of such personal information.

Methods of data handling by overseas recipient

For the purpose of providing talent acquisition and talent management services, your general personal information will be directly received by the overseas British Council UK’s careers portal hosted on the Eightfold platform, which will result in the transfer of your general personal information. The methods of data handling by the British Council UK as the overseas recipient include data collection, data storage, data use, automated recommendations, data retransmission, and data deletion. We have signed relevant data processing agreements with the overseas recipient, requiring them to handle your personal information securely and only for the agreed purposes.

Method of consent for data transfer

If you check this letter and click the "Submit" button, it will be deemed that you agree to the transfer and sharing of your general personal information with the overseas recipient listed in the “Names and Information of Overseas Recipient” section of this Consent Letter.

Applicable law and dispute resolution

This letter becomes effective from the date you check and click "Submit," with a validity period of 2 years after we confirmed the result of the recruitment process with you. Disputes arising from or related to this letter shall be resolved according to the applicable law and dispute resolution method stipulated in the PIPL.
